The Supreme Court of Canada decisions in the Haida Nation and Taku River cases have had a significant impact on the development of new energy projects in Ontario. These two decisions established an obligation on the government to consult with (and accommodate) First Nations in circumstances where new projects are being contemplated on lands currently subject to unresolved First Nation claims or disputes. While the duty applies to the government, its practical implications are borne by project developers.
This seminar, led by Richard King, Valerie Helbronner, and Pierre-Christian Labeau, takes an in-depth look at the legal context for the duty to consult case law, and provides participants with some practical guidance on dealing with First Nation issues in the context of project development.
