Canada Amends Patent Law to Allow Compulsory Licences for Export of Pharmaceuticals

EXPERTISE
Canada was the first country in the world to implement the August 30, 2003 decision of the General Council of the World Trade Organization (WTO), allowing compulsory licences for the export of pharmaceuticals to address public health problems.The Act will come into force by Cabinet order, presumably after the government has had time to draft regulations that will provide more detail about the intended operation of the system. Regulations are currently expected by the fall of 2004.
