Biography

Mr. Levy practises mainly in the areas of banking law, corporate finance, financial services and commercial law. Since joining the firm, he has been actively involved in a number of high-profile transactions representing both financial institutions and corporate borrowers in major financings, on a syndicated and non-syndicated basis.

Mr. Levy has developed particular expertise in the area of asset-based lending in which he has acted as counsel to various leading domestic and foreign lending institutions in Canadian, cross-border and international transactions, including the financing of prominent national and international organizations. Mr. Levy also regularly represents both lenders and corporate borrowers in insolvency and restructuring efforts (including debtor-in-possession financings) as well as in real estate, receivables, project, structured and traditional bank financing and in securitization and factoring transactions.

Selected Client Work

Mr. Levy has acted recently for:

  • Bank of America, N.A., as Administrative Agent and Collateral Agent in the amendment and restatement of the senior secured asset-based revolving credit facility in the principal amount of US$1.1 billion in favour of Michaels Stores, Inc., and certain of its subsidiaries
  • Bank of America, N.A. in connection with the exit financing of Nortek, Inc. and its affiliates with respect to a US facility in the amount of $230 million and a Canadian facility in the amount of $20 million 
  • CIT Business Credit Canada Inc., as agent, in the $70 million restatement of the financing of Olco Petroleum Group Inc.
