Biography

Ian Clarke practises in the area of federal regulatory and administrative laws that affect business, with particular emphasis on competition/antitrust law, government procurement law and international trade law. He also practises in the area of intellectual property law, with particular emphasis on patent, copyright and trade-mark law.

Since 2006 Mr. Clarke has gained valuable experience in competition/antitrust matters relating to allegations of refusal to deal, abuse of dominant position, conspiracy and restraint of trade. He has also gained experience advising clients on all aspects of federal, provincial and municipal government contracting in Canada, including bid preparation, regulatory compliance, trade treaty rights, bid challenges and litigation.

With respect to his intellectual property practice, Mr. Clarke continues to gain experience in matters of patent and copyright litigation, as well as prosecution and litigation issues relating to trade-marks (including the management of trade-mark portfolios throughout the world).

Prior to joining the firm, Mr. Clarke served as a judicial law clerk to the Honourable Justice John M. Evans of the Federal Court of Appeal.

Mr. Clarke has appeared before all levels of the Federal Courts of Canada and the Supreme Court of Canada.

Selected Client Work

Mr. Clarke has acted recently for the following clients:

  • Servier Canada Inc. in connection with a successful claim for patent infringement, and successful dismissal of a counterclaim brought pursuant to the Competition Act
  • Westco Group Inc. in connection with the successful dismissal of a private application filed with the Competition Tribunal to obtain an order forcing Westco to supply all of its live chickens to one customer
