Biography

David Collier practises in all areas of intellectual property law, with an emphasis on litigation. He represents clients before the Quebec courts, the Federal Court of Canada, the Federal Court of Appeal and the Copyright Board of Canada on matters involving patent, trade-mark and copyright law, industrial designs, protection of trade secrets and unfair competition. Over the past several years Mr. Collier has successfully defended trade-mark infringement actions involving famous or well-known marks.  He has also obtained and executed a number of Anton Piller seizures, both in the Quebec Superior Court and the Federal Court of Canada allowing the seizure and preservation of evidence pending trial.  In addition, Mr. Collier has pleaded numerous cases involving the liability of directors and officers for breaches of the Copyright Act, and the piercing of the corporate veil.  Mr. Collier has also obtained court injunctions protecting clients from unfair competition and the use of trade secrets by former officers and employees.

Mr. Collier has acted as lead litigation counsel before the Copyright Board of Canada and the Federal Court of Appeal in novel copyright matters involving the private copying of musical works and the transmission of these works on the Internet. Mr. Collier has also acted as lead counsel in tariff applications before the Copyright Board brought by educational book publishers, as well as by music publishers, performers and producers of sound recordings.  Mr. Collier has extensive experience before the Federal Court of Appeal in judicial review proceedings.
