Happy ending to the saga of the roof of the Montréal Olympic Stadium

Following an unusually long settlement conference, that lasted five days and was presided by the Honourable Mr. Justice Richard Wagner of the Superior Court, the Olympic Installations Board (OIB), Birdair Inc., Rousseau Sauvé Warren Inc. (RSW) and their respective insurers as well as the various exhibitors and third parties who claimed to have sustained damage when one of the roof panels of the Stadium failed in January 1999, settled all 22 cases related to the failure without any admission of liability. The details of the agreements entered into must remain confidential. Birdair inc. is represented by Ogilvy Renault.
The OIB sued Birdair Inc., which had designed and built the roof, and the engineering firm of RSW for $50 million to build a new roof, and for $13 million for loss of profits. Furthermore, 20 actions totalling more than $21 million were instituted by the exhibitors, their insurers and third parties for the damage they allegedly sustained as a direct result of the failure and the Show being cancelled or moved to different locations in the following years.
At the time of the settlements, the main files ($50 million and $13 million) were ready to proceed to trial. For the liability issues alone, 150 days of hearing had been set aside by the parties, 99 witnesses to the facts were to testify, and more than 4,482 documents and 17 expert reports had been served, not to mention the thousands of pages relating to the quantum that had been sent to the defendants by all of the plaintiffs prior to the settlement conference.
