Montréal Litigation team wins important victory
May 22, 2007
We are proud to announce that a team of litigators from the Montréal office, consisting of Jean Bertrand, Éric Dunberry, Marie-Christine Hivon, Christine Lebrun and Andres Garin, won an important victory on May 22, 2007 in the dispute pitting our client Bombardier against Alstom Canada Inc. Mr. Justice Pierre Jasmin of the Quebec Superior Court dismissed a motion for a safeguard order presented by Alstom Canada, thereby allowing the Société de transport de Montréal (STM) to continue discussions with Bombardier on new cars for the Montréal metro pending the Court's decision on the merits. Mr. Jasmin ruled that the delay resulting from the suspension of discussions between the STM and Bombardier was not in the public interest or in the interest of metro users. The hearing on the merits will continue in the fall. This victory is of considerable importance to our client as the case enters the next phase.
