Direct-to-Consumer Communications
Direct-to-consumer (DTC) communications raise difficult issues in the marketing of prescription drugs and drugs indicated for diseases as set out in Schedule A to the Food and Drugs Act. Canadian and US laws differ dramatically in this area. Our expertise includes:
- Advising on the constitutional validity of restrictions on advertising
- Developing communications campaigns, drafting or revising communications copy that does not breach the regulatory restriction
- Liaising with the Health Products and Food Branch on challenges to a DTC campaign
- Assessing product liability repercussions of DTC communications
- Conducting risk analysis relating to scope and extent of a communication strategy
- Working with government agencies on legislative changes to communications restrictions
